SALES TERMS AND CONDITIONS

1. Purpose and general

These General Conditions of Contract (hereinafter, the “General Conditions”), together with the particular conditions that may be established, regulate the conditions of purchase of products through the website www.veggunn.com (hereinafter, the “Website”), owned by Laboratorios Zamdeh, S.L., with C.I.F. B87625067, (hereinafter “Veggunn”), whose registered office is located at C/ Mauricio Legendre, 13 Madrid 28046.

The use of the services of the Website, as well as the acquisition of any of the products offered by Veggunn in the portal (hereinafter, the “Products” or the “Product”), implies the acceptance by the User, without reservations of any kind, of each and every one of these General Conditions. The registration in the Portal and the use of the services entails that your data as User will become part of Veggunn’s files, and its treatment will be in accordance with the provisions of the Privacy Policy, which the User expressly declares to know and accept.

Veggunn provides information about the Products, and offers the possibility of their acquisition through the Web. Persons who intend to purchase the Products must have the status of “Registered User”, which is acquired by completing the respective form at the beginning of the purchase process and following the steps that Veggunn subsequently communicates through the Web.

These General Conditions, together with the Legal Notice and the Privacy Policy of the Website, are the only conditions applicable to the use of the Portal and the acquisition of the Products through it and replace any other conditions, unless previously agreed in writing between Veggunn and the User. Consequently, the User who accesses the Web, registers and makes the purchase of Products through the Web accepts to submit and is bound by the General Conditions, the Legal Notice and the Privacy Policy as they are written at the time of accessing the Web.
All Users registering on the site must be at least eighteen (18) years of age.

Product Information

The descriptions, photographs, graphic or iconographic representations and videos related to the Products offered by Veggunn on the Portal, as well as trade names, trademarks or distinctive signs of any kind contained in the Web, are intended to provide as much information as possible. However, the User must bear in mind that they are for guidance purposes only and, consequently, are not exhaustive.

Veggunn reserves the right to decide, at any time, the Products offered to the Users through the Website.

Veggunn also reserves the right to stop providing access, at any time and without prior notice, to any of the Products offered on the Portal.

The products sold on the website are not medicines.

3. Purchase of the Products

To proceed with the purchase of the Products, the registered User, who must be over eighteen (18) years of age, must select the Product he/she wishes to purchase and add it to the Shopping Cart/click on the “CONTINUE” button.

The User’s name, e-mail address and password provided to Veggunn are identifying and enabling elements to access and make the purchase and are personal and non-transferable. All this data is processed and encrypted, for your security, through a secure SSL server.

Once the purchase process is completed, Veggunn will send to the email address provided by the User, an email confirmation of receipt of the order within twenty-four (24) hours after the completion of the order. Veggunn shall send to the User, upon request, the corresponding invoice within less than thirty (30) days from the execution of the purchase.

4. Product Availability

In the event that, due to force majeure circumstances, a Product is not available after the purchase has been made, Veggunn will inform the User by email of the total or, if applicable, partial cancellation of the order. The partial cancellation of the order does not give right to the cancellation of the entire order, without prejudice to the exercise of the right of withdrawal that corresponds to the User in accordance with the provisions of these General Conditions.

5. Price of the Products

The prices of the Products offered through the Web include VAT (10%), in the case of Spain and other EU countries, in other countries VAT and any other applicable taxes will not be applied. Shipping costs will be applied for purchases less than what is detailed on the page and in these conditions, at the User’s expense:

These deadlines begin on the working day on which the product is made.

If the order is placed on a public holiday or Saturday, the term will start to run from the next working day.

Veggunn reserves the right to modify the prices reflected on the Web, at any time. The Products will be invoiced at the price in force reflected on the Web, at the time of registration of the order.

6. Payment of Products

The payment of the price of the Products purchased and the shipping costs, which will be detailed during the purchase process, can be made by credit or debit card, or through the Paypal gateway.

To proceed with the payment, the User must follow the instructions that appear on the screen, providing the required information:
We inform you that Veggunn will not keep information regarding the bank details of the Users.

The User shall notify Veggunn, through the email veggunn@veggunn.com any undue or fraudulent charge in the account provided for the purchase of the Products offered on the Website, in the shortest possible time, so that Veggunn can take the steps it deems appropriate.

7. Cancellation of the order

The User may proceed to the cancellation of his order before Veggunn has shipped it.

Once this period has elapsed, the User may not cancel his order, without prejudice to the exercise of the right of withdrawal that corresponds to him in accordance with the provisions of these General Conditions.

If the User has been charged at the time of cancellation of the order, Veggunn shall reimburse the amount paid by the User as soon as possible and, in any case, within thirty (30) days from the cancellation.

8. Delivery of the Products

Veggunn only delivers within the European Union (hereinafter the “Territory”), according to the specifications of each product.

Veggunn undertakes to deliver the products purchased by the User in the purchase process in the shortest possible time, and in any case, within thirty (30) calendar days from the date of placing the order. Delivery will be made to the address indicated for this purpose in the registration process or to the shipping address indicated by the user during the purchase process within the Territory.

Veggunn shall not be liable for any errors or damages caused in the delivery when the delivery address provided by the User does not match the place of delivery desired by the User.

9. Return of products

(i) Right of withdrawal

The User shall have a maximum period of fourteen (14) calendar days from the delivery of the Product to withdraw, in whole or in part, from the purchase thereof, in accordance with applicable law.

Products that have been unsealed by the User may not be returned.

Once the period of fourteen (14) calendar days has expired, Veggunn will not accept returns for withdrawal of Product purchases.

In the event of withdrawing from the purchase of a Product, the User must contact Veggunn by sending an e-mail to veggunn@veggunn.com.

In any case, in the event of cancellation of the purchase, the following requirements must be met:

1) The Product must be in the same condition in which it was delivered and must retain its original labeling. If the Product is not returned in its original packaging, it may be subject to depreciation.

2) The return to Veggunn must be made using the same box or envelope used in the delivery or, failing that, in a similar format that guarantees the return of the Products in perfect condition.

3) A copy of the proof of purchase and the delivery note of the Products must be included inside the package, indicating the Products returned and the reason for the return.

Returns of orders should be sent to Veggunn’s address: C/MAURICIO LEGENDRE, 13 – MADRID 28046. The User shall bear the return shipping costs in case of exercise of the right of withdrawal.

(ii) Return of defective Products

Without prejudice to any other rights to which it may be entitled, the User shall be entitled to reimbursement of the price of defective Products or Products delivered if they do not correspond to the order placed by the User.

In the event of return to Veggunn of defective Products or Products that do not correspond to your order, this shall be done by the User through the procedure set out in paragraph (i) above, although the User, in this case, shall not bear the costs of returning such Products.

Provided that the User has followed the procedure set forth in paragraph (i) above and the requirements set forth in these General Terms and Conditions have been met, Veggunn shall refund the price paid for returned Products that are defective or do not correspond to the product order placed by the User.

(iii) Reimbursement of the price of the Products to the User

Provided that the User has followed the procedure set out in these General Conditions and the requirements set out in these General Conditions have been met, Veggunn shall refund the price paid by the User for the Products returned. In the event that the return is made in exercise of the User’s right of withdrawal described in paragraph (i) Veggunn shall not pay or bear the costs and / or costs of return.

The User shall not be entitled to reimbursement of the price of returned Products that are not in the same condition in which they were delivered, or the requirements set forth in these General Conditions have not been met.

Partial returns of an order will result in the reimbursement of the price corresponding to the Product(s) actually returned.

Veggunn will manage the order for refund of the price through the same payment system used by the User to purchase the products, within thirty (30) days from the collection of the returned order and once Veggunn has verified that the returned products meet the requirements set forth in the following paragraphs. (i) and (ii) above. The application of the price refund to the User’s account will depend on the bank.

10. Product Warranty

The User has the right to replacement or termination of the contract, which shall be free of charge in accordance with the applicable regulations.

The User, once the product has been purchased, may choose to demand the replacement of the product, provided that the option chosen can be complied with and is not disproportionate.

The User shall inform Veggunn of any non-conformity within two (2) months of becoming aware of it, and Veggunn shall be liable for any non-conformity within two (2) years of delivery.

The warranty does not cover deficiencies caused by negligence, improper use or manipulation, blows, and/or use not in accordance with the instructions for use.
To make use of the replacement, it is essential to keep the proof of purchase of the Products.

11. Communications between User and Veggunn

All communications between Veggunn and the User regarding these General Conditions or the purchase of the Products through the Website shall be made in accordance with the communication procedures set forth in these General Conditions for each particular case.

For all other cases not expressly regulated in these General Conditions, the communications that the User intends to send to Veggunn shall be addressed to Veggunn’s address indicated in the First Condition and shall be made in writing and through a system that allows to prove the content and receipt by Veggunn of the corresponding communication.

12. Integrity of the General Conditions

These General Conditions, the Privacy Policy and the Legal Notice constitute the express and sole will of Veggunn and the User in relation to its object and invalidates and replaces any other agreements or contracts, verbal or written, reached by the parties previously.

13. Partial nullity

In the event that any Clause of these General Conditions is declared null and void, it will be withdrawn or replaced. In any case, such declaration of nullity shall not affect the validity of the rest of the provisions contained in these General Conditions.

14. Applicable Jurisdiction and Jurisdiction

These General Conditions are governed by and construed in accordance with Spanish law.
The parties submit, at their option, for the resolution of disputes and waiving any other jurisdiction, to the courts and tribunals of the domicile of Veggunn.
